The petitioner seeks bail in a case under section 302 and 201 of the Indian Penal Code.

The petitioner is not named in the F.I.R. The informant lodged the case on the recovery of dead body of his brother who was suspected to be a thief. During the course of investigation it has come that the deceased had entered into the house of the petitioner for committing theft and the inmates of the house assaulted the deceased. Consequently, the deceased died. The police after investigation submitted charge sheet under section 304/34 of the Indian Penal Code. No specific allegation of assault is made against the petitioner.

Considering the facts aforesaid, the petitioner,

Patna High Court Cr.Misc. No.20011 of 2015 (2) dt.17-06-2015 above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Civil Line P.S.
