JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304-B, 302 of the Indian Penal Code.

Petitioner happens to be husband of the deceased who died in mysterious circumstances at her matrimonial home. Police after due investigation submitted charge sheet under Section 304-B of the I.P.C. Moreover, the perusal of impugned order goes to show that trial of the petitioner has already commenced and out of nine prosecution witnesses, two prosecution witnesses have already been examined. Regard being had to the above stated facts and

Patna High Court CR. MISC. No.2696 of 2019(3) dt.28-03-2019 2/2 circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail for the present and accordingly, his prayer for bail in connection with Sessions Trial No. 146 of 2018 arising out of Terhagachh P.S. Case No. 46 of 2018 stands rejected.

However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
