Heard learned counsel for the petitioner and the State. Earlier prayer for pre-arrest bail of the petitioner was refused by this Court vide order dated 6.7.2022. Again same prayer has been made on the ground that the petitioner is ready to deposit the loss amount incurred by the bank to the tune of Rs.7,33,560/-, in the Court below, subject to the final result of the case.

In view of the undertaking of the petitioner, prearrest bail petition is allowed. In the event of surrender within six weeks from today, let the petitioner, named above be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Naugachia in Gopalpur Police Station Case No. 32 of 2021/Gr No.1179 of 2022, subject the conditions laid down under section 438(2) of the Cr.P.C. as well as on the following conditions:- Petitioner would be filing a receipt of deposit of

Patna High Court CR. MISC. No.12695 of 2023(3) dt.12-04-2023 2/2 Rs.1,50,000/- in the Court below at the time of his surrender and furnishing bail bonds within six weeks from today. Rest of the amount would be deposited by the petitioner in the Court below in three equal instalments within further six months.

Needless the state that if the petitioner fails to deposit the instalments, as undertaken by him, the Court below would cancel the bail bonds.
