The petitioner is languishing in custody for the offences punishable under Sections 328/302/34 of the Indian Penal Code.

The son-in-law of the petitioner died in the house of the petitioner in unnatural circumstances. Allegation is that the daughter of the petitioner, who was wife of the deceased, and this petitioner had administered poison.

Submission is that there is no eyewitness of the occurrence. During investigation some of the witnesses stated that for dispute between the husband and wife for sending money to the father of the deceased, the deceased might have

Patna High Court CR. MISC. No.8755 of 2019(3) dt.26-04-2019 2/2 committed suicide. Wife of the deceased has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.1336 of 2019. The petitioner is in custody since 30.08.2018. Investigation of the case is complete.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Marauna P.S. Case No.71 of 2012, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
