JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 304/34 of the Indian Penal Code.
As per the prosecution case, on 04.08.2021 the informant came to know that his brother, Mintu Rai, was apprehended by the villagers while stealing battery and he was brutally assaulted as a result of which he died during the course of treatment. It is alleged that 20-25 persons, including this petitioner, assaulted his brother resulting in his death. Learned counsel appearing for the petitioner submits that informant is not an eye witness of the occurrence and petitioner was made accused in this case only on suspicion. It is
Patna High Court CR. MISC. No.4067 of 2022(3) dt.12-05-2022 2/2 submitted that as per FIR itself a mob of 20-25 persons assaulted the deceased. It is next submitted that petitioner was made accused only because he lodged Begusarai Town PS case No. 484/ 2021 against the deceased for theft of battery of his erickshaw. Petitioner claims clean antecedent and is in custody since 14.09.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town PS case No. 505/2021.
