Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but it would appear from perusal of the FIR itself that it was coaccused, Nageshwar Yadav who opened fire on the deceased. Moreover, it is submitted on behalf of the petitioner that in course of trial, informant as well as some other witnesses including the injured of this case have already been examined but they have not stated about the involvement of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.17276 of 2015 (3) dt.15-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Ad hoc Additional Sessions Judge-II, Supaul in connection with Sessions Trial No. 93 of 2012 arising out of Birpur P.S. Case No. 176 of 2008.
