Deceased, Bhola Paswan, who came out from his house in the night of 24.07.2014, became traceless and his dead body was found on 26.07.2014, on account thereof, his mother, informant, Sajni Devi gave her fard-beyan wherein she had shown suspicion against the petitioner and others in the background of continuing illicit relationship in between the daughter of petitioner namely Priyanka with the deceased and for that, it has been disclosed that petitioner had earlier threatened. After perusal of the case diary, it is evident that call details of deceased's mobile was taken out wherefrom it is apparent that last call was in between the deceased and Ashok. It is also evident from the case diary that whatever materials happens

No.17316 of 2015 (03) dt.22-06-2015 to be, that happens to be against Ashok Mahton and further, the witness examined under Paragraph-20 of the case diary speaks regarding Priyanka, at whose instance deceased had proceeded. So far petitioner is concerned, neither there happens to be direct evidence nor the conclusive, circumstances emerging out from the case diary.

Accordingly, petitioner Ram Japo Mahton @ Rakesh Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Rameshwar Mishra, Judicial Magistrate, 1st Class, Begusarai in connection with Naokothi P. S. Case no.90 of 2014.
