After closing his shop informant, a goldsmith while was in a way to his house along with his father having ornaments fallen prey at the hands of dacoits who looted away the ornaments (enlisted) after assaulting the informant. Informant claimed nonidentification by name and accordingly, FIR was registered against unknown.
It is apparent from para-45 of the case diary that five persons were apprehended including the petitioner and for that Dawath P.S. Case No.100 of 2014 was registered under Sections 399, 402 IPC along with Arms Act and during course thereof, it has also been alleged that out of five, four have confessed their guilt as well as their involvement during course of commission of instant offence and it has further been disclosed as per para-53 of
Patna High Court Cr.Misc. No.17152 of 2015 (3) dt.23-06-2015 the case diary, that certain booty has been recovered from the house of co-accused Madan Paswan. From the case diary, it is apparent that neither the articles have been put on T.I. parade nor the petitioner along with other co-accused though, have already been remanded in this case, subsequently.
Petitioner has got a chequered history. However in the background of aforesaid deficiency, petitioner Sanjay Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned SDJM, Bikramganj, Rohtas in connection with Dawath P.S.
