JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Runnisaidpur P.S. Case No. 02 of 2015 registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. Allegedly, three persons were apprehended and three succeeded in fleeing away and from possession of apprehended accused, fire arms were recovered and they disclosed the name of the petitioner also that he fled away with arms. Submission is of false implication and that the petitioner has not been apprehended at the spot, nothing ahs been recovered from his conscious possession, other co-accused

Patna High Court Cr.Misc. No.8995 of 2016 (2) dt.25-04-2016 2/2 Himanshu Kumar has already been allowed bail vide Cri. Misc. No. 24943 of 2015 who was caught at the spot with fire arm, further co-accused Saroj Ray @ Saroj Rai has also been allowed bail vide Cri. Misc. N. 55135 of 2015 and the petitioner suffering in custody since 05.11.2015, deserves sympathetic consideration. The learned A.P.P. submits that the petitioner has got criminal antecedent as he is involved in three more cases. In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Runnisaidpur P.S. Case No.

02 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
