JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 461, 379, 411 of the Indian Penal Code.
The informant named the petitioner on the basis of suspicion but in course of investigation, police recorded the confessional statement of petitioner leading to recovery of stolen mobiles from possession of co-accused, Mukesh Kumar. Learned counsel for the petitioner points out that coaccused, Mukesh Kumar has already been granted privilege of bail by a co-ordinate Bench of this Court and so far as petitioner is concerned, except suspicion as well as so-called confessional

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 355 of 2015.
