The petitioner seeks bail in connection with Rupaspur P.S. Case No. 351 of 2019, registered under Section 147, 148, 149, 341, 323, 353, 337, 338, 307, 504 and 302 of the Indian Penal Code.

The accusation is that on receiving information about causing assault to some persons in village Sevra near canal spreading the rumour of committing theft of child by them, the informant, along with other police personnel, reached there, then, saw that more than 200-300 people were indulged in causing assault to three persons through lathi, stick and pelting brick and stone. Anyhow, three persons were saved, who had

No.1973 of 2020(2) dt.23-01-2020 2/2 sustained injuries out of them two were identified as Chandan Kumar and Subhash Singh and they were send to Sadar Hospital, Danapur, for treatment. At that time, 36 persons were apprehended from the mob and five persons including the petitioner were identified in fleeing condition. Submission is that the petitioner was not apprehended on spot and due to misunderstanding, he has been implicated in this case with allegation that the petitioner was also seen at the place of occurrence. The petitioner has no criminal antecedent and is in custody since 22.11.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rupaspur P.S. Case No. 351 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, II, Danapur, Patna. (Rajendra Kumar Mishra, J) Shamshad/- U T
