The petitioner seeks bail in connection with Barmankhi P.S. Case No. 39/2011 for the offences punishable under sections 392 and 411 of the Indian Penal Code.

The prosecution story, in brief, is that one Rajesh Yadav submitted a written report before the S.H.O. , Baramankhi P.S. that his mobile, cash of Rs.700/- and the motorcycle were snatched by three miscreants.

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. nor he has been put on T.I.

Patna High Court Cr.Misc. No.19345 of 2015 (2) dt.11-06-2015 2 / 2 Parade to ascertain about the participation of the petitioner in the alleged occurrence. Further, it has been submitted that whatever articles have been recovered from the possession of the petitioner, they are not looted articles.

It has been further submitted that the petitioner is in custody since 14-8-2014.

It has been submitted on behalf of the State that the name of the petitioner has figured in course of the investigation, and he has played an active role.

Considering the facts and circumstances of the case, let the petitioner Panchanand Das @ Pancho Das be released on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Purnea, in connection with Barmankhi P.S. Case No. 39/2015.
