2. The petitioner seeks regular bail in connection with Motipur P.S. Case No. 242 of 2021 registered on 29.07.2023 lodged under Sections 420, 467, 468, 471, 414, 120B of the I.P.C. and 30(a)/31/32(i)(ii)/36/41(i)(ii) of the Bihar Prohibition and Excise Amendment Act, 2018 which has been rejected vide order dated 16.10.2023 in Cr. Misc. No.66341 of 2023 with liberty to the petitioner to renew his prayer for bail after framing of charge.
3. Counsel further submits that petitioner is in custody since 30.07.2023 having no criminal case pending against him. Counsel further submits that charge has already been framed. On 13.12.2023 case has been fixed for evidence and two witness
Patna High Court CR. MISC. No.12121 of 2024(3) dt.19-04-2024 2/2 has already been examined but thereafter no one had appeared.
4. Learned counsel for the State opposes to prayer for bail and submits that upon perusal of the progress report which was called on earlier occasion, trial is likely to be concluded within six months and huge quantity has been recovered from the possession of the petitioner.
5. In the present fact and circumstances, this Court is not inclined to enlarge the petitioner on bail at present. Accordingly, the bail application stands rejected. (Dr. Anshuman, J) Sunnykr/- U
