JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-01-2019 Petitioner is seeking anticipatory bail in connection with Deoriya P.S. Case No. 156 of 2018 dated 30.10.2018 registered for the offences punishable under Sections 365 and 366/34 of the Indian Penal Code.
It appears from the allegations made in the First Information Report that the mother of the victim girl had alleged that while her daughter had gone to meet the call of nature, she was kidnapped. This petitioner has been specifically named in the F.I.R. In the impugned order of the learned Sessions Judge, Muzaffarpur, it is stated that in her 164 Cr.P.C statement the victim girl has alleged that she was confined in a room and this petitioner had committed wrong act with her.
Learned APP for the State is present and has pointed out from the impugned order that in the given facts and
Patna High Court Cr.Misc. No.2714 of 2019(2) dt.28-01-2019 2/2 circumstance the privilege of anticipatory bail be not allowed to the petitioner.
In the given facts and circumstances of the case which have been taken note of hereinabove, this Court is not inclined to grant anticipatory bail to the petitioner. The application is dismissed.
