The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 395/397/412 of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, some unknown miscreants entered the house of the informant, assaulted the informant and his family members, made firing and looted house hold articles.

Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused but petitioner has not been

Patna High Court CR. MISC. No.3929 of 2022(3) dt.16-05-2022 2/2 identified in the Test Identification Parade. No looted article has been recovered from the possession of this petitioner. Petitioner claims clean antecedent and he is in custody since 25.6.2021. Investigation is complete.

Learned counsel appearing for the State and the informant vehemently opposed the prayer for bail. Considering the aforesaid facts and circumstances of the case and the fact that the petitioner has not been identified in the TI parade, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Begusarai in Barauni Police Station Case No. 134 of 2021.
