There happens to be allegation against the petitioner to be in possession of stolen motorcycle and was arrested therewith. From the written report itself, it is apparent that there happens to be addition on that very score at the relevant place which makes the prosecution case if not unreliable but doubtful. Furthermore, from para-3 of the pleading, it is apparent that petitioner has got no criminal antecedent.

In the aforesaid facts and circumstances of the case, petitioner, Udai Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town (Nagar) PS.
