====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-01-2019 Heard learned counsel for the petitioner, counsel for the informant and the State.

The petitioner seeks bail in Sahebpur Kamal P.S. Case No. 182 of 2018, instituted for the offence under Section(s) 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.

It is alleged in the written report that Md. Nayeem executed a forged sale deed in the name of Soni Devi with respect to 4 Kathas 12 1⁄2 dhoor land of the informant. It is further alleged that petitioner was identifier of Md. Nayeem. The sale deed has been executed with respect to the land belonging to the informant. There is no person with name of Md. Nayeem. Petitioner has wrongly identified fictitious

Counsel for the petitioner submits that one of the witnesses of sale deed namely Sudhir Kumar Rajak has been granted bail by this Court vide order dated 27.11.2018 passed in Cr. Misc. 61987 of 2018. Petitioner is said to be identifier on the sale deed. Petitioner was not the beneficiary of the sale deed.

Petitioner is in custody since 1.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S. Case No. 182 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
