1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 363, 366(A) of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that his minor daughter, aged about 17 years had fled thrice before, further on 24.06.2023 it is alleged that she fled with an unknown accused with an intention to marry, it is next alleged that her friend Bholi can disclose about her whereabout.
4. The learned counsel submits that petitioner is not named in the F.I.R. and the victim came back and her statement was recorded under section 161 Cr.P.C., wherein she has disclosed her age as 20 years and stated that she has married the petitioner and in support also showed marriage certificate (Annexure-2 to the
Patna High Court CR. MISC. No.4038 of 2025(3) dt.09-05-2025 2/2 anticipatory bail application), further that she is carrying pregnancy of three months, thereafter her statement was also recorded under section 164 Cr.P.C., wherein she has not supported the case of the prosecution. It is further submitted that petitioner and the victim were in love and they eloped and thereafter they got married. It is also submitted that had the victim been a minor in that event the marriage certificate would not have been issued.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bahadurpur P.S. Case No.235/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
