Patna High Court CR. MISC. No.4801 of 2022(2) dt.24-08-2022 2/3 offences alleged under Sections 304B and 201/34 of the Indian Penal Code, registered in connection with Patory P.S.Case No. 181 of 2021.

As per allegation, the marriage of the informant's daughter was solemnized with the petitioner Subodh Kumar Singh (Cr.Misc.No. 3609 of 2022). The couple were blessed with a female child, who is presently three years of age. It is further alleged that the informant got an information that the accused persons committed the death of his daughter due to non-fulfilment of demand of dowry.

The learned counsel for the petitioners has submitted that the deceased was suffering from acute Tuberculosis (Drug Resistant Tuberculosis). She was under treatment in Ram Manohar Lohia Hospital in New Delhi and also she was treated in National Institution of Tuberculosis and Respiratory Disease, New Delhi. She died due to chronic ailment of tuberculosis and this false case has been lodged. He has submitted further that when the informant perceived his mistake, he filed a compromise petition.

Considering the above facts and circumstances, let the petitioners of both the cases, above-named, in the event of their arrest or surrender within four weeks from the date of

No.4801 of 2022(2) dt.24-08-2022 3/3 communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM-II, Samastipur in connection with Patory P.S.Case No. 181 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
