The petitioner is in custody since 08.11.2018 in connection with Fesar P.S. Case No. 67 of 2018 for the offence registered under Section 304 of the Indian Penal Code. Learned counsel for the petitioner submits that though the allegation has been carved out against the petitioner as he is the husband of the deceased lady, there is no material to indicate that actually there had been any assault on the deceased-lady. It is further submitted that the daughter of the deceased lady has categorically stated that she was sleeping along with her mother and her mother fell down from the Chouki. It has also been indicated that her mother was suffering from illness on account of the sad demise of her only son and also she was admitted in the hospital after falling down from the Chouki.
