The order dated 23.05.2022 is recalled and the same is replaced with the following order:- Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. Learned counsel for the petitioners is permitted to remove defect(s) as pointed out by the office, if any, within a period of four weeks from today.

The petitioners are in custody in connection with Pre Trial No. 560 of 2021 arising out of Kasba P.S. Case No. 248 of 2021 registered for the offences under Sections 30(a),

Patna High Court CR. MISC. No.4012 of 2022(3) dt.22-06-2022 2/2 38(i) and 41(i) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

The petitioners are driver and cleaner of the struck. They belong to the State of Punjab and they have clean antecedents. They are in custody since 22.10.2021. Considering the aforesaid facts, this regular bail application is allowed.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Purnea, in connection with Pre Trial No. 560 of 2021 arising out of Kasba P.S. Case No. 248 of 2021.

This is subject to the condition that petitioners shall mark their attendance in Kasba Police Station, District- Purunea on first Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioners.
