The petitioner seeks bail in Bachhwara P.S. Case No. 142/2014 under Sections 302, 201/34 of the Indian Penal Code. The petitioner is not named in the F.I.R. The informant alleged that her daughter Nasima had gone to see the fair but she did not return. The informant disclosed two mobile nos. 08405861170 and 09128970096 on which her daughter was talking. During the course of investigation, one Rajiv Kumar was arrested and he confessed his guilt and disclosed the names of the petitioner and other accused persons. It is submitted that except the confessional statement of Rajiv Kumar, the investigating officer did not collect any tangible evidence and the petitioner is rotting in jail since 14.11.2014.

Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.5843 of 2015 (3) dt.15-04-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deopriya Kumar, Judicial Magistrate 1st Class, Begusarai in Bachhawara P.S. Case No. 142/2014.
