JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are said to have assaulted the deceased by means of Musar, as a result of which deceased died in course of treatment.
The contention on behalf of the petitioners is that there is allegation of assault to the deceased against the petitioners as well as other accused persons but only one injury has been found on the head of the deceased and, therefore, it is not clear who caused the said injury to the deceased. Moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail by this Court.
Patna High Court Cr.Misc. No.16282 of 2016 (2) dt.22-04-2016 2/2 Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S.Case No. 92 of 2014.
