JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 The petitioner has renewed his prayer for bail in connection with Khutauna P.S. Case No.59 of 2011 registered under sections 394 and 411 of the Indian Penal Code. The application for bail of the petitioner was earlier rejected by this Court vide order dated 23rd July, 2014 passed in Cr. Misc. No.24640 of 2014.

It has been contended that till date the petitioner has remained in custody for over one year and two months but there is no progress in trial.

Be that at may, regard being had to the criminal antecedent of the petitioner as well as reasons assigned in the aforementioned order dated 23rd July, 2014 passed in Cr.Misc. No.24640 of 2014, I am not inclined to grant bail to the petitioner

Patna High Court Cr.Misc. No.18871 of 2015 (2) dt.29-04-2015 2/2 for the present. Accordingly, the prayer for bail is rejected. The learned Judicial Magistrate, 1st Class, Madhubani before whom the matter is pending, is directed to expedite the trial and conclude the same as early as possible preferably within nine months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail.
