JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner, who has got criminal antecedent, has again been apprehended along with co-accused, Kundan Kumar and on search, from the possession of the petitioner, a countrymade loaded pistol along with cash appertaining to Rs.6,800/- and from the possession of co-accused, Kundan Kumar, one cartridge has been recovered. Petitioner happens to be under custody since 08.09.2014.
Learned counsel for the petitioner submits that petitioner is in a way to reform as in between 2010 to 2014, save and except the present case, petitioner has not been an accused in any other case. Further, undertakes to be genuine and sincere under his conduct in reformatory way.
Patna High Court Cr.Misc. No.17635 of 2015 (02) dt.13-05-2015 On the other hand, learned Additional Public Prosecutor opposed the prayer.
Regard being had to the facts and circumstances of the case, petitioner, Md. Firoz Khan @ Kallu Khan is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sheosagar P. S. Case no.200 of 2014, subject to condition that petitioner will file an undertaking disclosing therein that henceforth, he will not be indulged in any sort of criminal activity, in violence thereof, the privilege, so granted, will automatically cease.
