2. The petitioner apprehends arrest in connection with Banka P.S. Case No. 401 of 2023 dated 14.06.2023, instituted for the offence punishable under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

3. Allegation against the petitioner is that he produced forged/fake certificate for getting employment as Special Survey Amin on contractual basis.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that petitioner has been terminated from service of the Land Revenue Department. It is further submitted that other similarly situated persons, namely, Manish Kumar,

No.6482 of 2025(2) dt.31-01-2025 2/3 Rakesh Kumar Sharma @ Rakesh Sharma and Abhinandan Kumar have been granted bail vide order dated 17.02.2024 passed in Criminal Miscellaneous No. 5412 of 2024 by this Court and another co-accused, namely, Sohan Kumar has been granted bail vide Criminal Miscellaneous No. 14579 of 2024 by a co- ordinate Bench of this Court. Other co-accused persons, namely, Rajlal Kunwar and Devendra Prasad Kunwar have also been granted bail vide Criminal Miscellaneous No. 19997 of 2024 by another co-ordinate Bench of this Court. Further submission is that co-accused, Kulwant Kumar, has also been granted bail by this Court by order dated 19.07.2024 passed in Cr. Misc. No.51581 of 2024. Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka, in Banka P.S. Case No. 401 of

Patna High Court CR. MISC. No.6482 of 2025(2) dt.31-01-2025 3/3 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
