The petitioner seeks bail in Jehanabad P.S. Case No. of 2014, corresponding to Sessions Trial No.

137/2015/99/2015 registered for the offences punishable under Sections 364, 302, 201 and 120(B)/34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 11.03.2015.

It is submitted that the trial has not yet been concluded and only five witnesses have been examined.

It appears that it is a case of kidnapping with murder of two persons and on the basis of confession the ring of the deceased was recovered.

Patna High Court Cr.Misc. No.9267 of 2016 (5) dt.20-07-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

However, the trial court is directed to expedite the trial and hold the trial on day-to-day basis and conclude the same within a period of six months. The S.P. Jehanabad is directed to ensure the attendance of all the witnesses of Jehanabad P.S. Case No. 297 of 2014, corresponding to Sessions Trial No. 137/2015/99/2015 so that the trial must be concluded within six months from the date of receipt/production of a copy of this order. The trial court is further directed to inform this Court, if the S.P., Jehanabad fails to produce the witnesses during the course of trial so that necessary action be taken against him. If the trial is not concluded within six months, the petitioner may renew her prayer for bail before the court below. Let a copy of this order be transmitted to the S.P. Jehanabad.
