The petitioner, who has retired from the post of Panchayat Sevak in the year 2010, has approached this Court for a direction to the authorities to pay him A.C.P. and M.A.C.P. and thereafter fix the last pay, and on that basis only, his post retiral dues be paid to him.

It is submitted on behalf of the petitioner that he was appointed on the post of Panchayat Sevak in the year 1971 and after serving for 38 years, superannuated in the year 2010. Never, in his tenure, was he promoted and

Patna High Court CWJC No.1772 of 2019(2) dt.01-02-2019 2/2 therefore in accordance with the A.C.P. Rules of 2003, he is required to be given the benefit of financial progression. Since the benefit of scheme of financial progression was not given to him, he has to survive with meagre pension. It has also been submitted on behalf of the petitioner that on several occasions, representations were filed by the petitioner ventilating his grievance but all such representations have fallen on deaf ears.

The petitioner, in the circumstances, is directed to make a representation before the District Magistrate, Gaya (Respondent No. 2) within a period of three weeks. On receipt of such representation, the District Magistrate, Gaya shall look into the matter and dispose off the representation by passing reasoned order within a period of six weeks thereafter.

With the aforesaid observation / direction, this writ petition stands disposed off.
