The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323,341,342,324 and 307/34 of the IPC.
The prosecution case as per the written report of Suresh Mistry submitted to the SHO, Makhdumpur Police Station is to the effect that the informant made protest with regard to constructing stair on the pathway, it is alleged that co-accused Dharmendra Paswan assaulted on the head of the informant causing injury and this petitioner assaulted with knife to the son of the informant, namely, Santosh Mistry, as a result, he received cut injury.
It is submitted by learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled
Patna High Court CR. MISC. No. 4406 of 2020(2) dt.28-02-2020 2/2 and injury has been found simple and co-accused Dharmendra Paswan, Kavindra Pswan, Suraj Paswan , Karu Paswan and Gopal Pandey have been granted bail vide order dated 20.11.2019 passed in Cr. Misc. No. 54814 of 2019 by a Coordinate Bench of this Court. Learned APP submits that the petitioner is named in the FIR with specific accusation.
Considering the genesis of the occurrence and the injury being superficial simple in nature, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Jehanabad in connection with Makhdumpur P.S. Case No. 233 of 2019 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
