The petitioner seeks bail in connection with Piyar (Hatha O.P.) P.S. Case No. 123 of 2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Sections 30(a) and 41 of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 19.11.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 174.750 litres of liquor from a pickup van.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Piyar (Hatha O.P.)
