The grievance of the petitioner in the present writ application is non-consideration of his case for grant of promotion to the post of head master. On behalf of respondent No.6, counter affidavit has been filed wherein paragraph 5 of the same, following stand has been taken :- "5. That in the present context it is most respectfully submitted that from perusal of the records it has been manifest

Patna High Court CWJC No.5381 of 2017 dt.22-03-2018 2/2 that the claim of the petitioner for promotion to the post Headmaster is under active consideration in as much as, appropriate direction in this regard has already been issued to all block education officer vide letter No.1556 dt.15.07.2017 to receive application from all eligible's for promotion to the post of headmaster as well as for promotion in graduate trained sale and submit the same, so that on the said basis provisional graduation could be prepared for the purpose of considering for promotion."

In view of the above stand taken by the respondent in paragraph 5 of the counter affidavit, this writ petition is disposed of with a direction to the respondent to take final decision on the claim of the petitioner for grant of promotion in graduate trained sale and on the post of head master within a maximum period of 60 days from the date of receipt / production of a copy of this order.
