JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 376, 302, 201/34 of the Indian Penal Code.

Petitioner is named in the first information report along with some others but only suspicion has been raised against the petitioner on the ground that one day prior to the alleged occurrence, a quarrel had taken place between deceased and petitioner and thereafter, petitioner had given threatening to deceased. Moreover, none has seen the actual killing of the deceased and in course of investigation, witnesses stated only to the above stated extent and they have not claimed to have seen the

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent and is languishing in jail custody since 27.08.2015, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali in connection with Jandaha P.S. Case No. 170 of 2015.
