The petitioner is languishing in custody for the offences punishable under Sections 25(1)B, 26, 35 of the Arms Act.

Submission is that when the police was investigating Sahebganj P.S. Case No. 157 of 2000, a pistol was found near the dead body. During investigation, it was suspected that the petitioner had planted that pistol to show that the deceased committed suicide. Further submission is that there is no eye witness of the aforesaid occurrence. No one claims to have seen the petitioner planting the pistol. Petitioner is in custody since 12.10.2020. Investigation of the case is already complete.

No.14283 of 2021(2) dt.07-07-2021 2/2 Considering the submissions aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Sahebganj P.S. Case No. 181 of 2000, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
