ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Nasriganj (Rajpur) P.S. Case No.89 of 2013 for allegedly having committed the offence under Sections 406, 409, 419 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation of defalcation is squarely against one Bir Bahadur Ram and it is only this petitioner who had given information to the informant Sheo Narayan Lal, who was the Programme Officer of MANREGA scheme, regarding withdrawal being made by said Bir Bahadur Ram.

Considering the aforementioned facts and

No.18403 of 2015 (3) dt.18-09-2015 2/2 circumstances and that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, District-Rohtas, in connection with Nasriganj (Rajpur) P.S. Case No.89 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
