JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-04-2023 The present writ petition has been filed seeking the following relief:- "1.(i) Quashing the order dated 09.02.2016 passed by Collector cum District Magistrate, Nawadah whereby and whereunder the construction of school building has permanently been stopped.
(ii) For direction to the respondents for finishing the construction of school building which has been half constructed by the resolution of Gram Panchayat"
Patna High Court CWJC No.3918 of 2017(2) dt.21-04-2023 2/2 At the outset, the learned counsel for the respondent-State has submitted, by referring to the order dated 09.02.2016, passed by the District Magistrate, Nawada, that the District Magistrate has already given direction to first register the land, given by way of gift and then commence the construction of the building of primary school, hence, the respondent-State would definitely take appropriate steps to do the needful.
Having regard to the facts and circumstances of the case, I direct the District Magistrate, Nawada to ensure that the needful formalities for the purposes of registration of the gifted land in question, is completed forthwith and the construction of the building in question, is started within a period of six weeks from today. The writ petition stands disposed off with the aforesaid directions.
