The petitioner in this case is seeking regular bail in connection with Basantpur P.S. Case No. 393 of 2019 registered for the offences punishable under Sections 363, 364, 364(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been implicated in this case only on the basis of suspicion as he was working earlier as driver of the informant. It is further submitted the victim boy has been recovered from the house of co-accused Vicky Singh and from there said Vicky Singh has been arrested. It is further submitted that the petitioner is in custody since 25.10.2019 having no criminal antecedent.

Patna High Court CR. MISC. No.2988 of 2020(2) dt.18-01-2020 2/3 Learned APP for the State has opposed the prayer of regular bail of the petitioner.

Considering the facts and circumstances of the case wherein it is the submission of learned counsel for the petitioner that the victim boy has been recovered from the house of one Vicky Singh, co-accused, and the said Vicky Singh was arrested from the house where the victim boy was kept and has further submitted that this petitioner was earlier working as driver of the informant and has been involved in this case on mere suspicion and further submission is that the petitioner has no criminal antecedent and has remained in custody since 25.10.2019, in the nature of submission and the fact that the recovery has been made from the house of Vicky Singh who has been arrested by the Police from the spot, let the petitioner above named be released on bail in connection with Basantpur P.S. Case No. 393 of 2019 on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, subject to the condition as laid down under Section 437

(3) Cr.P.C. as under:

(a) that such person shall attend in accordance with the conditions of the bond executed under this Chapter,

No.2988 of 2020(2) dt.18-01-2020 3/3 (b) that such person shall not commit an offence similar to the offence of which he is accused, or suspected, of the commission of which he is suspected, and (c) that such person shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police officer or tamper with the evidence.
