The petitioner apprehends his arrest in connection with Madhepura PS Case No. 296 / 2022 dated 23-03-2022 registered under Section 363, 366A, 365 / 34 of the IPC. As per the prosecution case on 16-3-2022 at about 7:30 P.M. the minor granddaughter of the informant had gone to the flour mill of Pavan Yadav but did not return back to her home. Upon search it came to knowledge that Abhishek Kumar, S/o Pawan Yadav and Vikash Thakur @ Vikash Kumar had kidnapped the granddaughter of the informant and fled away on motorcycle.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. The girl was recovered and her statement under Section
Patna High Court CR. MISC. No.9027 of 2023(2) dt.19-05-2023 2/2 164 Cr.P.C. was recorded as would be evident from Annexure- 2 to this petition in which she has not stated anything objectionable against the petitioner. Petitioner is said to be the co-villager of the co-accused / Abhishek Kumar. Regard being had to the submission made by the parties and taking into consideration the statement of the victim girl recorded under Section 164 Cr.P.C., I am inclined to grant anticipatory bail to the petitioner.
Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Madhepura in connection with Madhepura PS Case No. 296 / 2022 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
