JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Muffasil P.S. Case No. 61 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 07.08.2021, charge-sheet has been submitted and is a persons with clean antecedent and allegation is of recovery of 285 Cartoons of foreign liquor from a Truck. Learned counsel for the petitioner submits that the petitioner was not arrested at spot and neither he was the driver

Patna High Court CR. MISC. No.3603 of 2022(2) dt.04-03-2022 2/2 nor the owner of the truck. Learned counsel submits that the real owner of the truck showed a false document to the police disclosing that he was transferred the truck in the name of the petitioner, when the vehicle was never transferred in the name of the petitioner.

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Muffasil P.S. Case No. 61 of 2018.
