In this case, the petitioner is seeking anticipatory bail in connection with Complaint Case No.2325C of 2017, registered for the offence punishable under Section 406 of the Indian Penal Code.

It has been alleged that the informant has purchased a Policy from the Post Office and in pursuance thereof, he used to hand over the money to the present petitioner. Allegation has been made that the petitioner has deposited the money for 18 months but thereafter the rest money has been misappropriated by him.

Learned counsel for the petitioner has pointed out

Patna High Court Cr.Misc. No.3178 of 2019(2) dt.24-01-2019 2/2 that the complainant in paragraph no.10 of his statement has stated that he used to hand over the money to Shama Ara, Post Master and used to receive the receipt against the payment made by him.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, Bibi Shama Ara @ Shama Ara, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M., VI, Araria, in connection with Complaint Case No.2325C of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
