Petitioner is accused in connection with Pandarak P.S. Case No. 127 of 2013 corresponding to Sessions Trial No. 534 of 2014 registered under Section 364 of the I.P.C. and later on, 302, 201, 120B/34 of the I.P.C. was added. The accusation is that Jyoti Kumar, brother of the informant proceeded for his Sasural on 07.09.2013 at 5.00 pm. but he did not return and thereafter, on 09.09.2013 information was given to the Police Station about missing of Jyoti Kumar by informant Prakash Kumar and later on, informant came to know on 10.09.2013 that his brother Jyoti Kumar had been killed in Sasural by in-laws.

Patna High Court Cr.Misc. No.19309 of 2015 (4) dt.09-09-2015 2/2 petitioner submits that dead body of the deceased, husband of the petitioner was recovered from the road side and his motorcycle was recovered from another place. In course of investigation, the police recorded the confessional statement of Rahul Kumar, who confessed his guilt about committing the murder of deceased Jyoti Kumar, husband of the petitioner in conspiracy with petitioner Soni Kumari and in-laws' family members by administering the sulfas in liquor. It is also submitted that Rahul Kumar has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 32628 of 2014, whereas Raushan Kumar, brother of the petitioner has also been allowed bail by a Bench of this Court vide Cr. Misc. No. 4472 of 2014 on 19.06.2014. It is further submitted that petitioner is in custody since 12.09.2013.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-Vth, Patna in connection with S. Tr. No. 534 of 2014 arising out of Pandarak P.S. Case No. 127 of 2013. (Rajendra Kumar Mishra, J.) Shail/- U T
