This application for anticipatory bail arises out of Tajpur P.S. Case No. 21 of 2019 for the offence punishable under Sections 30(a), 41(ii) of the Bihar Prohibition & Excise (Amendment) Act, 2018.
It is submitted by learned counsel for the petitioner that the petitioner had sold the vehicle, in question, to one Shiv Kumar prior to the incident and in support thereof he has annexed the agreement to sale of the vehicle as Annexure-2 to this bail application.
Considering the aforesaid facts, this application is
Patna High Court CR. MISC. No.15468 of 2021(2) dt.03-12-2021 2/2 allowed. Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge -cum-Special Judge (Excise Act), Samastipur, in connection with Tajpur P.S. Case No. 21 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
