JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 17-02-2024 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State duly assisted by learned counsel for the informant.

2. The accused/petitioners are named in the FIR and appending their arrest in connection with Nayagaon P.S. Case No.53 of 2023 for the offences punishable under Sections 341, 323, 354, 504, 379, 506, 324 and 307 read with 34 of the Indian Penal Code.

3. As per the case of prosecution, the petitioners along with other co-accused persons who are their family members arrived at the house of informant and started to abuse her on 03.10.2023 at about 8:00 p.m. and when same was

It is submitted by learned counsel that the informant and petitioners are family members/sister-in-law (gotni), where on issue out of partition of rooms, the present occurrence took place, where allegation regarding assault is appearing very much general and omnibus against both the petitioners, who are ladies and of clean antecedent.

The learned APP duly assisted by Mr. Subhesh Pandey, learned counsel appearing for the informant submitted that the above-named petitioners assaulted collectively to the informant on her private parts whereas he conceded fairly that injury as caused due to aforesaid assault was of simple in nature.

6. In view of aforesaid facts and circumstances and by taking note of fact as both above-named petitioners are ladies, where allegation of assault appears collective causing simple injury and both the petitioners are of clean antecedent, accordingly, the above-named petitioners are directed to be released on bail in the event of their arrest or surrender within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial
