The petitioners seek bail in Mohammadpur P.S. Case No. 220 of 2021, registered for the offence punishable punishable under Section 30(a), 37(b), 33 and 34 of the Bihar Prohibition and Excise Act, 2016 and sections 272, 273, 328, 307, 304, 120(B) and 34 of the Indian Penal Code. Only allegation against petitioners are that they also consumed wine at the house of Chhathu Ram along with other persons.

It is submitted that no recovery has been made from conscious possession of this petitioners. On the basis of

Patna High Court CR. MISC. No.3635 of 2022(2) dt.31-03-2022 2/2 statement of co-accused Bhola Ram, petitioners have been made accused in this case. No case under Section 307 is made out against the petitioners, as none has sustained injuries. The offence under Sections 328, 304 IPC is also not attracted against this petitioners. Petitioners are in custody since 09.11.2021. Petitioner no. 2 has got no criminal antecedent. Investigation is complete.

Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II, Gopalganj in connection with Mohammadpur P.S.
