The petitioner is accused in connection with G.B. Nagar P.S. Case No. 238 of 2019 registered under section 392 of the I.P.C. pending in the Court of Judicial Magistrate, 1st Class, Siwan.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 15.09.2019. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that in the Test Identification Parade, petitioner was identified and in the

Patna High Court CR. MISC. No.2066 of 2020(2) dt.24-01-2020 2/2 case diary, witnesses have also supported the prosecution version.

Having considered the above facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
