JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in connection with Parihar P.S. Case No. 241 of 2013 registered under section 392 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 02.09.2014 passed in Cr.Misc. No.28029 of 2014 with following observations :- "Since the petitioner is in custody, learned Chief Judicial Magistrate, Sitamarhi is directed to proceed with the trial of the case on day-to-day basis and conclude the same as early as possible preferably within a period of six months from the date of receipt/ production of a copy of this order failing which the petitioner would be entitled to renew his prayer for bail."
Patna High Court Cr.Misc. No.19342 of 2015 (2) dt.29-04-2015 2/2 It has been contended that the petitioner is in custody since 16th February, 2014 but till date no witness has been examined on behalf of the prosecution in course of trial. Regard being had to the observations made in the aforementioned order dated 02.09.2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Parihar P.S. Case No.241 of 2013.
