Perused the writ petition filed by the petitioner and the counter affidavit filed on behalf of the respondent nos. 5 to 7.

This application under Articles 226 and 227 of the Constitution of India has been filed by the petitioner for

Patna High Court CR. WJC No.487 of 2017(2) dt.05-08-2019 2/2 directing the official respondents to arrest Dharmendra Mahto, an accused in Maranchi P.S. Case No. 86 of 2015 dated 01.09.2015 registered under Sections 406, 417, 420 read with 34 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

In the counter affidavit filed on behalf of the respondent nos. 5 to 7, it has been stated that the writ petition has got no merit as the absconding accused of Maranchi P.S. Case No. 86 of 2015 Dharmendra Kumar has already been arrested by the police officer of Maranchi Police Station and produced before the court of Sub-Judge-IV-cum-A.C.J.M., Barh, Patna and is in judicial custody.

Since the grievance of the petitioner has already been redressed, the application has become infructuous. It is dismissed, accordingly.
