Petitioner seeks bail in Nokha P.S.Case No.15 of 2008 registered for the offences under Sections 302 and other sections of the IPC and Section 27 of the Arms.

The petitioner is not named in the first information report. His name figured in the confessional statement of one Surendra Paswan and except this, there is no other tangible evidence on the record. Although some of the witnesses in para50 of the case diary disclosed the name of the petitioner saying that they saw the petitioner and other accused persons fleeing but they are not the eye witnesses of the occurrence. Of course, the petitioner was named in the confessional statement but he, after being arrested, was not put on T.I.P.

Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Incharge,
