Heard learned counsel for the petitioners and the State. The petitioners pray for grant of bail in a case registered for the offence punishable under sections 341, 385, 387, 504 and 506/34 of the Indian Penal Code.
As per prosecution case, alleged date and time of occurrence, petitioners along with other accused assaulted the informant and forcibly harvested crops and also demanded levy of Rs. 50,000/- It is submitted on behalf of the petitioners that admittedly, there is land dispute between the parties. He further submits that RS Khatiyan indicates that land in question is entered in the name of
Patna High Court CR. MISC. No.15352 of 2021(2) dt.23-07-2021 2/2 Ram Janam, grand father of the petitioners and the said land was still in possession of the petitioners and the informant wanted to take possession of land in question forcibly. Petitioners have got clean antecedent and are in jail custody since 21.11.2020. Learned counsel for the State opposes the prayer for bail. Considering the period of custody and clean antecedent, this bail application is allowed. Let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Chenari P.S. Case no. 224/2020 on the following conditions.
(1) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on their absence on two consecutive dates without sufficient reason, his/her bail bond shall be canceled by the Court below.
(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
