The present application has been filed for modification of the order dated 04.12.2018 passed in Cr. Misc. No. 72312 of 2018 by which the petitioner was granted bail in connection with Madanpur P.S. Case No. 209 of 2017 to the satisfaction of learned Additional Sessions Judge-VII-cum- Special Judge, (Excise), Aurangabad and the petitioner was directed to surrender in the Court below within a period of six weeks and furnish bail bonds.

Learned counsel for the petitioner submits that inadvertently due to typographical error in the cause title of petition of Cr Misc. No. 72312 of 2018, the father's name of the petitioner has been typed as "Rabali Mian" in place of "Rajubi

Patna High Court Cr.Misc. No.6934 of 2019(2) dt.15-02-2019 2/2 Miya" and the same appeared in the order dated 04.12.2018 passed in Cr. Misc. No. 72312 of 2018.

Considering the submissions made on behalf of the learned counsel for the petitioner and in view of the statement made in paragraph no. 4 of the present application, let in the cause title of order dated 04.12.2018 passed in Cr. Misc. No. 72312 of 2018, the father's name of the petitioner be read as "Rajubi Miya" in place of "Rabali Mian". The period of surrender of the petitioner in the Court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.

The order dated 04.12.2018 passed in Cr. Misc. No. 72312 of 2018 is modified to the extent as indicated above. The modification application is, accordingly, allowed. (Sudhir Singh, J) Pankaj/- U T
