The petitioner seeks regular bail in connection with Udwant Nagar P.S. Case No. 439 of 2019 for the offence registered under Sections 341, 323, 385, 04, 506/34 of the Indian Penal Code .

The allegation is regarding the accused persons having intercepted the informant and demanded a sum of Rs. one lac per month by way of extortion money and in the event of failure to do so they had threatened the informant with dire consequences. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and as far as the present case is concerned, there is no allegation of commission of any sort of assault upon the informant and in fact another case bearing Udwant Nagar P.S. Case No. 440 of 2019 has been lodged regarding assault and firing by the accused

Patna High Court CR. MISC. No.1955 of 2020(2) dt.14-01-2020 2/2 person, namely, Ajay Yadav, hence it is submitted that as far as the present case is concerned, the petitioner has no complicity in the case. It is further submitted that apart from other case bearing Udwant Nagar P.S. Case No. 440 of 2019, the petitioner is having a clean antecedent and he is languishing in custody since 30.11.2019.

Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the petitioner as also taking into account the fact that there is no allegation of any assault or having committed any loot as far as the present case is concerned, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S.
